These terms apply to your use of this website. By browsing the site or sending an enquiry through it, you accept them. If you do not accept them, please do not use the site.
Who the site belongs to
This website is operated by Toyzie Studio. The studio works with clients internationally. You can reach us at hello@toyziestudio.uk.
Using the site
You may read the site, share links to it and enquire about the work. You may not:
- use it for anything unlawful, fraudulent or harmful
- attempt to gain access to any part of it, or to any system connected to it, that has not been made available to you
- interfere with how it runs, including by introducing malicious code or placing an unreasonable load on it
- copy or extract the content in bulk, whether by hand or by automated means, for republication or for a competing service
- use the enquiry form to send unsolicited marketing, or to submit somebody else’s details without their knowledge
We may withdraw access to the site from anyone who does not keep to this section.
The content on this site
Everything published here is for information. It describes what the studio does and how it approaches the work, and it is written in good faith, but it is general. It is not professional, legal, financial or marketing advice for your particular situation, and it should not be relied on as the sole basis for a business decision.
Nothing on the site is an offer capable of acceptance. Service descriptions, engagement formats and any indication of what is included are illustrative. The scope, the deliverables, the timing and the price of a piece of work are agreed in writing for each engagement.
Enquiries do not create a contract
Sending an enquiry, receiving a reply or discussing a possible project does not create a contract between us and it does not reserve capacity. A contract exists only once we have both agreed a written engagement, covering scope, fees and timing.
Intellectual property
The design of this site, its text, its layout, the Open Lens mark, the Toyzie Studio name and the other brand elements are owned by the studio or used with permission. You may not copy, adapt or republish them without our written consent, other than the ordinary browser copies made in order to view a page, and short quotations with a link back to the source.
Work produced for a client is treated differently. On payment in full, rights in the final deliverables prepared for that client transfer to the client. The detail, including anything licensed rather than transferred, such as third party fonts, stock assets or the studio’s own internal templates and working methods, is governed by the individual engagement agreement rather than by these terms. Where the two differ, the engagement agreement takes precedence.
Links to other sites
Where we link to another organisation, it is because we think it is useful or because we are citing a source. We do not control those sites, we are not responsible for their content or their privacy practices, and a link is not an endorsement.
Availability
We aim to keep the site available and up to date, but we do not promise that it will be uninterrupted or free of errors. We may change, suspend or withdraw any part of it, at any time, without notice. Content may become out of date, and we are not obliged to update it.
Liability
Nothing in these terms limits or excludes our liability for:
- death or personal injury caused by our negligence
- fraud or fraudulent misrepresentation
- anything else that cannot lawfully be limited or excluded
Beyond that, and because the site is provided for information without charge, we are not liable for any loss of profit, loss of business, loss of contracts or goodwill, loss of data, or any indirect or consequential loss arising from your use of the site, from your inability to use it, or from your reliance on anything published on it.
Liability for work the studio carries out for a client is a separate matter, dealt with in the agreement for that engagement.
If you are using the site as a consumer rather than for business purposes, nothing here affects your statutory rights.
Privacy
Personal data sent through this site is handled as described in our privacy notice, which forms part of these terms.
Changes to these terms
We may update these terms as the site and the studio change. The version published here is the one that applies, and the date at the top tells you when it was last edited. Please check it from time to time.
Governing law
These terms, and any dispute arising out of them or out of your use of this site, are governed by the law of the country in which Toyzie Studio is established, and the courts of that country have jurisdiction. If you are a consumer resident in another country, nothing here removes a right you have to bring proceedings in the courts where you live.
